1. Overview

These Terms & Conditions (“Terms”) govern your use of the Prosperity Labs website, services, automations, CRM tools, and the “Premium Automations” plan (the “Service”).

By purchasing, subscribing, signing up, or using any Prosperity Labs services, you agree to these Terms.

2. Who We Serve

Prosperity Labs provides digital marketing services, website design, CRM setup, automation workflows, and business growth tools to small businesses—primarily in Tulsa, Oklahoma, but also to U.S. clients.

3. Included Services

Your $297/mo plan provides access to:

- Hosting & website management

- CRM dashboard

- Lead capture forms

- Calendar & online booking

- Text & email automations

- Review generation tools

- Local business tools (pipelines, contact management, follow-up)

- Ongoing limited technical support

Prosperity Labs may add, remove, or modify features at any time.

4. Subscription & Billing

The subscription is billed at $297/month.

You authorize Prosperity Labs to automatically charge your payment method monthly.

Late or failed payments may:

- Pause your account

- Disable your website or services

- Suspend automations and CRM

- Result in additional fees assessed by your bank or card issuer

5. Refunds

Due to the nature of digital services, software access, and instant setup:

All payments are non-refundable.
Cancel anytime to avoid future charges.

Website setup, onboarding, and custom automation builds are also non-refundable.

6. Client Responsibilities

You agree to:

- Provide accurate business information

- Not misuse SMS/email tools

- Follow all applicable local laws (especially for marketing messages)

- Maintain compliance with TCPA, CAN-SPAM, and privacy rules

- Respond to support requests when needed to complete setup

7. Marketing & Messaging Compliance

Prosperity Labs provides tools for SMS/email automation.
You are responsible for ensuring:

- You have permission to message your contacts

- You comply with SMS carrier rules

- You include required opt-out tools

- You follow CAN-SPAM, TCPA, and related laws

Prosperity Labs is not liable for misuse of your messaging tools.

8. Liability Limitation

To the maximum extent permitted by law:

- Prosperity Labs is not liable for lost revenue

- Not liable for website downtime

- Not liable for lead quality or business outcomes

- Not liable for user errors or failure to follow recommendations

Total liability is limited to one month of service.

9. Termination

Either party may cancel at any time.

Upon cancellation:

- Website is disabled

- CRM access ends

- Automations stop

- No refunds are issued

10. Changes to These Terms

Prosperity Labs may update these Terms at any time. Clients may be notified when changes are material.
